Payment of overdraft after son's death.

    My son died suddenly back in January, he was unemployed, lived with us and had no assets of any saleable value except for a games console & a laptop, probably worth no more than €300 between them. In February I notified the two banks that he had accounts with and asked them to let me know what they wanted done next.
    On Monday 1st September I received a letter from Assisted Probate Services acting on behalf of one of the banks requesting that I pay them a sum of €830 owed by my son to that bank, in February the sum (overdraft) was only €630.
    While I am aware that I don't have to pay this, my question is, if I choose not to pay it what legal hoops do I have to jump through to prove that my son had left nothing of any value? Or does the matter rest there if I refuse to pay?

    You might want to go into the probate office in phoenix house smithfield dublin or give them a call. They are usually very friendly and might give you a steer. Otherwise you could contact flac or a solicitor.

    Sorry to hear about your loss, hopefully you can sort this out quickly with the above.

    I thought the banks were insured for these matters.

    Very sorry for your loss and it's terrible to have to be dealing with things like this.

    I am so sorry for your loss. Write to the Bank saying your son left no estate, and therfore the estate cannot satisfy the amount owing. They cannot pursue you.

    Thanks all for your replies, they were very helpful. For anyone else wanting to know about Assisted Probate Services I've discovered that they are part of the BCW Group, a Glasgow based debt collection agency. There is a thread about them here http://www.boards.ie/ttfthread/2056613456/1
