I've searched the forums but can't find an answer to my question.

My yearly tax was up August 31st.
I am out of the country from Sep 12th – October 30th.

I’d like to declare it off the road for all of Sep & Oct. (I Can drive the GFs car until the 12th)
Am I too late to declare the car off the road for September? Even though legally I couldn’t be driving the car anyways for the last 3 days?

Q2. If my vehicle is not in use, when do I need to declare it off the road?
A2. You must make your off the road declaration in advance. The declaration must be made in the month of expiry of your current motor tax disc. All correctly completed applications will receive confirmation of their transaction, either by post or on the spot if the declaration is submitted in person at your local motor tax office.

Any cases where Motor Tax office has been lenient on this?

I only got into the country on the 22nd September after a month abroad then had a family wedding which meant I completly forgot about this.

Is it a case where a trip to the local tax office and a bit of shmoosing could turn this around face-face? (have the proof of flights etc.)

Time travel aside, I really doubt the tax office can do anything for you considering its all computerised and the fact you were back in ample time to sort it.
    But sure ask them anyway.

Would your GF like to buy a car just like yours in Nov (hint hint)?

Your too late unfortunately, off road declarations must be made in advance before the tax is up.

As explained, you either pay at least 3 months tax (starting 1st sep), or you can transfer ownership to somebody else and then back to yourself when you are ready to tax it, thus eliminating any arrears due ( as hinted at by Slimjimmc).

BTW the High-Horse Brigade will be along shortly to admonish anyone for even contemplating such a course of action.....you may even be accused of Fraud or God-forbid...Tax Evasion......Ignore the lot of them, you're not doing anything illegal.

you should have "sold" the car to someone else and the arrears would have vanished. It's not cricket but it's perfectly legal as they haven't shut this daft loophole still.

Only really worth doing on an old car though where the number of cars doesn't drastically effect the resale value.

    Just to follow up:

No joy in declaring off the road after the start of the month.

Also the Motor Tax refund form is no good (RF120), even though I can prove I will be out of the country for 2 months come 21st September I still can’t get a refund for this period.
The only way this form would seem to work is if I was out of the country for a perfect 3/6/9 month period and still have 3 eligible months on the disc when I return.
I was also told they have never given out one of these out.

Quote from Local tax office ‘The new tax system makes it almost impossible for a legitimate person with legitimate reasons to avoid tax, they have gone from one extreme to the other’

Someone has their information wrong, you need 3 unexpired months left on the disc at the time surrender, I see no mention of 3 months from your return to the State.
IMPORTANT: Tax discs must be surrendered immediately as refunds are generally calculated from the first of the month following the surrender of the disc. A minimum of three unexpired whole calender months must be left on the disc when surrendered.
    http://www.environ.ie/en/LocalGovernment/MotorTax/Refunds/

I suspect this means you can only claim a refund if your current disc is valid until 31st Dec at least in order to have 3 unexpired months (Oct, Nov, & Dec).
