Circuit court, civil, service of pleadings query

    Hi,

    When an affidavit is sent out via registered post is it required that a statutory declaration of service ( along with the printout from An post) be lodged in the circuit court a few days later to confirm service ?

    No. It just needs to be produced in court. By turning up, that of course cures that.

    Sorry excuse my ignorance but is it only required when a motion is served & not an affidavit?

    Thanks so much - still learning & trying to figure out what's what. Trying not to look toooo foolish :-)

    In that case, I think all you'll need is a copy of the proof that the other person received it/signed for it. Bear in mind, An Post only retains online records for a limited period of time, so once it has been signed for, just make sure to print the details then.
