Holiday pay

    I need people opinion on this as i seem to be receiving mixed information online
    So here is the scenario,
    employee has given 4 weeks notice period as s/he found another job.
    employee has 3 weeks of unclaimed annual leave

    are they entitled to Payment for annual leave which you have earned but not taken?

    i dont think so? what do ye think?

    They would definitely be entitled to earned annual leave.

    do you have any legal document to back this up? it will really help

    Also, how is the payment decided in this circumstance? given that it is a monthly pay type of job

    Yes you have to pay this 3 weeks of holiday pay..

    Well of course they're entitled to payment for the annual leave accrued.

    If it's monthly pay, and they're due three weeks, you take their annual salary, divide by 52, multiply by 3, and that's what you pay them (in addition to whatever they're due in their final salary payment.) PAYE, PRSI and USC are deducted as normal.
