retention, is it over for good

    With these new changes in the regs and retention done away with, how does one go about getting a small extension made legal if it was built bigger that was originaly on the plans.

    The reason why I'm asking this is that my cousin added another 2 rooms at back of her cottage back in 2007 just after getting planning for a small extension. She knew you could retain the extra few rooms but never got around to it. What does she do now.

    The new "regs" are building control regulations, not planning.

    Retention is not "done away with".
    You are incorrect to think that.

    So it just can't be used for any new buildings but can for anything built before march this year

    no, youre getting confused.....

    the new building control regulations have no facility to retrospectively submit a commencement notice, and therefore theoretically is illegal to occupy.

    "retention planning permission" as a facility to regularise planning permission is still available and theres no plan to change it.


    its my own opinion that this fault (problem) in the building controls regulations will be recognized and fixed by means of another amendment in the future.
