looking for a solicitor in cork

    hi guys,

    i am looking for a good solicitor in cork prepared to argue my case with a well known bank bank over a 20000 euro missing bank draft that was made out in my name , i had asked for it to be taken from my savings account , but it wasnt , the bank created a loan for it , no loan agreement signed by me , the bank draft was handed back in , but went missing , was cashed by someone else .bank wont tell me by who ,but it has been cashed, bank denying any wrong doing, refusing to talk about it and i have been left with a loan , i am refusing to pay and now threatning me and quite aggressive . my current solicitor says pay up and move on?? ongoing for 7 years , banks deceived me 8 years ago cos when i complained about it ,they said because i fell behind in a private loan they couldnt sort it out as i had to regularise my affairs and sort out my other loan , so put they two loans together and then they would investigate . once i signed new arrange loan then they stopped talking to me , i have paid off what i owed in the other loan . my solicitor says i signed away my right to dispute it by signing the new loan and banks were too clever for me as that was their plan. pissed off customer

    Lots of missing details here.

    Who was the payee noted on the bank draft?

    It doesn't make sense to borrow money from a bank to get them to investigate their loss of your missing money. If a bank took my money wrongly, I'd sue it and then possibly report it to the Financial Services Ombudsman or maybe even the guards. I wouldn't sign a loan agreement before it would investigate. That just doesn't make any sense to me.

    If you have left matters for more than 6 years, you would have to check whether any action that you might wish to take might be statute barred at this stage. It is not clear when any loss occurred. It is also unclear why you did not take any legal action within 6 years.

    I would think that the above might be potential issues for discussion with your solicitor, or your new solicitor, if you find somebody new. However, If a solicitor thinks that a case is statute barred, he or she may be unwilling to act in the matter.

    If you had the money to cover it in your savings account, why didn't you just immediately transfer the money to the loan account?

    the manager said my money was locked in to a savings account for 7 days . ie need 7 days notice to withdraw , so i signed a withdrawal slip for its withdrawal and he gave me a bank draft . the reason i needed bank draft fell through so it was handed back in.
    draft was made out in my name only , but yet lodge into someone else account .
    i returned to ireland 4 years ago
    it has been in solicitors hands for last 8 months , no reponse by bank to solicitor .
    it was in accountants hands for 3 years loads of letters from accountant to bank looking for info , refused to discuss with accountant , he went to data protection crowd in dublin who were to suppose to release my file , loads of information missing .
    i young naive and was too trusting of the banks, never dealt with any legal entity before as was in my early twenties. didnt have money for solicitors, tried to deal with it myself , made loads of calls to bank looking for information and it was complicated by the fact that i was living abroad.
    thanks for info , it looks like i going to loose this after years of fustration

    If you had the money to cover it in your savings account, why didn't you just immediately transfer the money to the loan account?

    It was just resting in his account before he moved it on.

    Maybe it doesn't look great, at first glance. However, maybe you should put all of your info together, write out a clear account of what happened, and get a second opinion from a new solicitor. I imagine that it will cost you for him/her to check it out for you, as there is no guarantee that he would be paid otherwise, by the sounds of it.
