Redundancy whilst pregnant

    I am hoping someone out there can help! I was just told at work last week that the company is closing the site we work on in November & making everyone redundant :(
    I am just over 3 months pregnant & haven't told my employer yet. In my employment contract it says that the company will pay employees in full for 26 weeks maternity. It also outlines the fact that you have to take 2 weeks of this time before your due date & 4 weeks after and it is up to the employee as to when they take the other 20 weeks - i.e before or after due date!
    Anyway, someone recently advised me that if I go on maternity leave before the date I am going to be made redundant that the company have to pay me for the 26 week period & then give me my redundancy-can anyone advise if this is true or not? Basically what they are saying is that the company cannot make me redundant while I am on maternity leave?
    If this is the case also is it best then so to advise my employer now that I am pregnant & that I intend to start my maternity leave in November?
    I would appreciate any useful advice on this!

    No, you may not be made redundant while on maternity leave or additional maternity leave. You may be made redundant when you return to work or while you are pregnant before you go on maternity leave

    Thanks Stheno. Does this mean do you know that if I tell my employer that I intend to go on maternity leave on 20th November for example that they can then tell me they are making me redundant on 19th November?

    Well you'd still be working and not on maternity leave, so I imagine they could going by that wording up above.

    So you could go in tomorrow and advise them that you are pregnant and planning to take your maternity leave on November 5th.

    They could then announce that the location you work in is being closed down and everyone is being made redundant on October 31st.

    I meant to add, if you finish up within sixteen weeks of your maternity leave then you are entitled to Maternity Benefit still.

    All employees must have their leave certified by their employer. However, if your contract of employment ends within 16 weeks of the end of the week in which your baby is due and you satisfy the social insurance (PRSI) conditions, Maternity Benefit is payable from the day after the date on your P45.
