Unusual bail terms.

    Hiya all.

    I was reading the news recently and this struck me as unusual. Has anyone heard of a bail condition like this?

    "The person must be in possession of a mobile phone with the power on at all times."

    What is that about? Surely its not a veiled attempt to keep track of a persons wearabouts, is it??

    Or have I been reading to many conspiracy theories?:)

    No conspiracy, it's just if AGS ring the guy at any time and the phone is off then in breach of bail and can bring him before the court, to revoke bail. I have seen such conditions is it an extradition case by any chance.

    Why would they have to veil it? It's specifically so he can be contacted by Gardaí to see if he is complying with his bail conditions and curfew.

    It strikes me as loosely worded, if the quote up thread is correct

    A phone could have it's power on and be in airplane mode
    the sim card could be taken out
    the phone could be blocked by the teleco

    and still meet the condition.

    Surely, AGS would have to provide evidence of the bailee not being in possession of a powered on phone?

    But why would they want a phone switched on at all times. Is it not a bit pointless? Unless they wanted to keep track of his exact position?

    Its not an extradition case, but does involve travel - kindof.

    Simple, "sorry judge but you just told me to have a phone, not my fault it ran out of power just as AGS decided to ring me, so I had phone on me as promised."

    Keep in mind whats said in court/Written on his bail bond may be a bit more detailed than whats reported in the Evening Herald

    I would imagine it's because he is now excluded from travelling so if the guards ring him and get the foreign ring tone they can bring him in on breach of bail.

    They can't bring him in to court if he is outside the country they would need to either extradite or european arrest warrant.
