    Hello,

My transit failed DOE because of rust issues - other than that great engine, great body low mileage.

I can't afford to repair rust and need to get a different kind of vehicle anyway so figured I would sell it on to someone who could fix up rust issues or would use it for parts.

Now I've been told I should have declared it off the road 3 months prior to tax expiring - before I even knew I wanted to sell it.

What can I do in this situation ??

    Cheers

What were the rust issues? I have fixed a lot of rusty transits, some bits are a doddle, some bits a pain. You might have a doddle bit to fix.

you don't have to declare it off the road three months in advance although you should declare it prior to the tax expiring. If you sell it , there is no liability to back tax and the new owner taxes it from first of month of purchase.

If you want to keep it and say you are only able to fix in 6 months just sell van to family member (change of ownership) without selling if ya get me and put back in your name after and tax again so no problems.

They start a new system but there is usually a way around;)

As said above new owner only pays tax from date of ownership and you are not liable for tax.

    When is your tax expiring?
If it's still taxed, then you still can declare it off the road.
f.e. if your tax expires by the end of July, you can declare it off the road on any day of July - 31st the latest.

Iv seen your post so sorry to hear it failed..I'm reading your post while I'm sitting out side the galway city recovery guys(the same company the gardai use to repossess) that take your car when u have no tax or nct or doe.. The recovery truck they use is covered in rust it's so bad u can hardly see the paint that once was on it, I cant see how they could possibly pass there own doe or are these guys exempt from the law because they make money for the state, I took photos but don't know how to post on this site..I'll try on my laptop later..rumor has it the cops and the particular recovery company are on the fiddle regarding back handers with all the business they are offering each other, but how can they get away with there trucks riddled in rust when they are repossessing other people's vans trucks cars and the like over rust and, A very suspect setup in liosban ind estate altogether if u ask me, as I was sitting there 2 patrol units were in and out like a flash they had to walk past the wreck of a recovery vehicle in question, I'm wondering how come it was not taken off the road for that very reason ,they were oblivious to the state of there trucks..I just done a google search and the owner of the place is registered as a private owned company

About ur rust problem... There is a rust restorer called krust paint it on and it turns rust back into healthy metal.. Respray it after a few days with a touch up can.. That will do for the smaller areas that needs paint , for under the bonnet leave as is as it will turn black or dark grey .. If there is a huge amount of rust u need to get a a 5ltr of converter and just spray on with one of those garden speakers u get for roses in woodies it's less time consuming than painting.. Hope things work out for all that has this problem
