Occupational Disablement Benefit - Late Claim

    Hi all

    I am just wondering if anyone can help me.

    I was injured while working nearly three years ago and received back injury, lacerations, soft tissue damage etc. i was absent from work on certified sick leave for three months and then returned. I have ongoing issues with back etc.

    I have only been made aware recently that I am entitled to Disablement Benefit. I have the form but it states you have to put claim through with in three months of accident or you may lose out on payment. Does anyone know if I can still apply for it?

    There's a section for my employer to fill out confirming accident happened etc and I will have to get them to sign it. Were they supposed to inform me of this benefit when I reported the incident?

    I appreciate any help.

    Fill in the form add a cover letter and sent it in.

    Thanks for your reply. I am going to send it in alright but I am wondering will it go against me that it's few years later & would they refuse me? I was never made aware and did not know this entitlement existed until last week.

    Do you know has your employer to notify you of this benefit?

    For what it's worth I was approx 5 mts late getting my cert in, not 3 years I know, but as stated put a cover note with application stating I did not know about this payment and since then have received a letter stating my case was now been processed.

    Apply with a letter of explanation and any up to date medical reports. The 3 months really applies to the clause that you would only get it backdated for 3 months, but to be honest, if you are succesfull in your application you will be happy enough.
