Forgot to put car off the road!

    for over 2 months i have had my car sitting in the drive, im trying to sell but didnt want to rush into buy a new car so just picked up a run around. the tax is really high on car so just said id leave it expire along with insurance as i wa selling it.

    i plan on trading in the car with a garage. problem is i havent declared it as off the road, its also not insured.

    only now have i had time to get around to looking for a new car!!

    where do i stand with regard to the tax, will i have to back tax the car now before i can sell it??:eek:

    As far as i know when the ownership changes on the car all the arrears are written off

    This is correct. Once the ownership changes all arrears disappear.

    To be more precise, they are not exactly written off, but just never existed.
    Arrears become due only when owner who had untaxed, undeclared car intends to tax it again.
    At the moment, OP is not due any arrears, so nothing will change after he sells the car.

    Hi everyone,

    The engine in my car blew about three months ago. I never declared it off the road, I wasn't aware I had too.
    I'm getting tax renewals in the post, it states I have to pay up.
    Is what you've said in previous post still stand in 2015....

    I sold a car there that was off the road untaxed for 2.5 years at 3.0 tax rate. That's about €3k

    My dearly departed car was nearly 5.5 years off the road when I sold it last year. I didn't spend €10k in motor tax that I could not afford :(

    Best of luck to the new owner. In a bit over a year the car will only cost €56 per year to tax :)

    I traded in my car to a dealer in November with 2 weeks tax left on it at the time - I am now getting final reminder letters about unpaid road tax - should I let them know I traded the car in or just ignore the letters?

    I'd let them know the dealer has it just in case it's not registered as being with a trader and you start getting other notices (fpns, toll charges).
    Did you complete Form RF105 when you sold it and did you send it to Shannon?

    Hi Slimjim - I didn't complete any paperwork for my old car, I wasn't aware I had to when trading in, I just gave them the logbook as I had always done in past trade-ins. Is it my responsibility or the garages to ensure this is done?

    Your responsibility. From the RF105 Notes linked in the Citizen's Information page (I've bolded the relevant bits)
    A. When to use this form
    This form should be used when any person or body has sold, traded-in or otherwise disposed of a vehicle registered since 1st January 1993 to a Motor Dealer. The completed form must be sent to the Department of the Environment, Heritage and Local Government, Shannon Town Centre, Co. Clare.

    D. What to do next
    When the Owner disposing of the vehicle and the Motor Dealer acquiring the vehicle have completed the form:
    • The OWNER DISPOSING OF THE VEHICLE should IMMEDIATELY forward this form to the Department of the Environment, Heritage and Local Government, Shannon Town Centre, Co. Clare.
    • THE OWNER DISPOSING OF THE VEHICLE where already licensed (taxed) will have been issued with a Certificate RF101 and in such cases the Certificate (with change of ownership section not completed) should be surrendered to the Motor Dealer.
