can you take a doctor to court if.......

    He misdiagnoses you? lets say the misdiagnosis was cancer and he saw a lump on you and said it was just a cist, and sure in six months time when your pregnancy is over we will then remove it when really he should have sent you for a biopsy? so you wait and wait and before you know it is six months in and you find out you have stage 4 cancer. the doctor misdiagnosed you so is he allowed to get away with it?

    It could be medical negligence depending on the facts but not criminal, as far as I know. I mean what law would you be thinking the doctor broke?

    Thanks you have a point. I am just thinking havnt many sued the hse for medical negligence in the past?

    I don't know if they have, couldn't tell you. Even if they have the case would be completely individual. A good place to start would be making a complaint to the Medical Council, if you haven't already. That's likely to give you an idea if it's considered the doctor was negligent or otherwise

    You would do well being able to sue them if they sawed off your leg with a chainsaw when they were supposed to be checking your temperature. Proving medical negligence here in Ireland is like proving you have found some Unicorn shyte. Doctors do not go against other Doctors. And you generally need a Doctor to qualify the negligence..

    There's something like 100 medical negligence cases per month in the Irish courts.
