Car finance in my friends name but not the reg owner

    Hi my friends husband took out a car loan in my friends name a few years ago and she wants to give the car back under the half rule, but he does not want to, even though he hasnt paid the loan since he got it. The car is registered to him but there is still 8k remaining to pay.

    What happens in this situation. Frudian slip in the title.

    Confused.. The HP is in her name and the car is in his name? Is that even possible?

    was it a car loan or was it HP? The half rule only applies to HP, not to car loans.

    It was a HP agreement, and not a car loan.

    Surely it's not possible to have the loan in one name, but the logbook in another? Couldn't she just arrange with the bank to take the car?

    Bank still owns the car. Your friend needs to speak to them and go from there

    The finance company owns the car till the last payment is made no matter whose name it is in. Even if he was to trade the car in or sell it on they are still the legal owners of the car. Its in the contract. She can stop paying and they will take it or sge can ring them explain the situation and they will send a recovery truck to collect it at his address with or without the keys or his permission.

    I was in this situation years ago. I asked the bank to take the car back under the half rule, they did, matter closed.
