Laws on carrying an opened container of alcohol in a vehicle

    Hi there

    Just a general question really!! There does not appear to be much information online about this one. My question is this.

    What is the law regarding carrying or drinking alcohol or having an opened container of alcohol in a moving vehicle within in a public place either stationary, driving or in a carpark etc in Ireland?

    There is no issue with it.

    It is legal to drink alcohol in a car and/or while driving a car in Ireland. It's just not legal to be over the blood-alcohol limit(s).

    The major stumbling block is that you may not be intoxicated and in charge of the vehicle - even if you're sitting in the back seat, if you're the guy with the keys, you will probably be prosecuted. Even opening the boot while drunk can land you in court.

    mind you ,no gardai would be too happy to see you slugging a bottle of jd while driving ,even if you were under the limit
    we have a great system in Ireland where we make up laws as we go along ..be warned

    Was going to a hen night recently and a Garda was with us. We asked same and her response was it wasn't really allowed but it would be a wanker of a gaurd that would do anything about it as long as driver wasn't drunk.

    It is amazing really that in America you can be a back seat passenger over the age of 21 and having a small bottle of budweiser and be prosecuted :confused::confused:

    Cheers guys for the answers, I guess that clears that one up. It is LEGAL to drive and have an open container in a moving car whilst the person is underneath the blood alcohol limits!!

    You also need to not be intoxicated.

    It would be better to say that there is no specific offence of having an open container.

    You might also check the bye-laws for the relevant council areas, which might have some implications.
