filming a street performance

    If a town has a festival with open air performance on street can it be filmed by anyone for hobby purposes, not intending to sell footage. Do the performers have right to privacy in public place.?

    Yes, but not to the extent that they can raise objections to being filmed in the course of a street performance.

    The right to privacy in public is highly contextual.

    You could confidently film a street performance that is intended for public viewing and easily accessed.

    But if for example, you later spotted the same street performer rushing home under the cover of darkness with a blow-up doll under his arm, a question of a violation of his right to privacy in public could conceivably arise if you attempted to photograph what you saw.

    The performer can of course object and stop their performance.

    Note that filming can consist of (a) filming only (b) nuisance behaviour.
