Hi, A friend of mine has recently found out her employer hasn't deduct enough tax from her. I realise the tax is owed to the revenue regardless of who is at fault. Its a large company, payroll dept etc. Given that it is there mistake, would she have a case to argue that they should have to pay it??? Appreciate any advice. Thank you.

firstly is your friend sure that the error occurred in the payroll dept. were they provided with the correct tax deduction details from Revenue and just not use them correctly or did Revenue not have the correct information provided by your friend.

However, either way, it is the responsibility of each employee to ensure that their own tax affairs are in order - even if the employer inputs the credits/cut offs incorrectly, Revenue places the onus on individuals to make sure its correct. Employer mistake would be unusual imo as Revenue sends out credits/cut offs electronically now and it is hard for an employer to get it wrong as payroll packages import the info directly from Revenue website.

If its a large amount make sure that her employers dont take it all in the one go , as she will have small wages otherwise .

Contact the tax office and explain what happened , and they will issue a week 1 tax credit cert , where tax can be repaid over a period of time .
