    I am posting this anon as i literally dont know my head from arse. I have a 20 year old who moved in with his Dad while i moved to the UK, we separated a long time ago & i have raised my son on my own for nearly 15 years. My son is going to College so is unable and unwilling to move as he has a partner too. He was happy enough to move in with his Dad as he thought it was a chance to build a relationship with him. He sorted it all himself and was to move out of our council house a few days after i left.

    Im ashamed to admit this but i was leaving the house owing arrears. 48 hours later he rang me to tell me he was not moving in with his dad, he had started to bring over his stuff and the state of the house/ his dad/ etc frightened the life out of him, his dad has some pretty serious mental health issues that we did not know about and to be honest we think he kept it from us as most of our contact was over the phone/ internet, so now hes back at our council house and with only jsa to pay his way,i dont know how to help him. Can he stay in the house when im not there and owing arrears? Its going to be 6/8 weeks before i can be of any financial help to him. Will the council evict him? Will he be made responsible for the arrears?

    Can anyone please advise me please? We have no other family in our town that can help us.

    could you contact the council and explain the matter?
    he has his own money and in a few weeks you'll be able to help, so i dont see why they would be understanding.
    hope you get things sorted.

    Im sorry to tell you this but as soon as the Council find out that your son is there on his own and not on the tenancy then I think its pretty certain that they will tell him he has to leave. . He wont be made liable for your debt though that will stay with you so your alright on that front.

    It is a horrible situation but the Council will want the house for a family from the housing list. They will not be happy that you didn't surrender the house back to them. A condition of a tenancy agreement is that you have to be in need of housing and as you no longer live in Ireland they will deem it that you do not need to be housed. Your son however is in need of housing but he would have to go on the list and wait for a place like everyone else. The only way that people can succeed a tenancy is if they get their name on the tenancy and are assessed for rent.

    Im not sure that contacting the Council here is the way to go ....unfortunately some other curtain twitcher in the area may report it. Im sorry to be the bearer of bad news :(

    No reason to be ashamed - we all make mistakes. IMO the best thing your son could do is go down to the local council offices and apply to go on the housing list. He will then be able to apply for rent allowance and get a private rented place of his own, even if it's in a shared house. (Going on the housing list is an indispensable step as people can't even access homeless accommodation without their housing need being accessed in this way.) If he just stays in your old council house, he's staying there under false pretenses and when (not if) the council find out, he will be slung out, and will have difficulty accessing rent allowance or other social welfare supports in future due to it. Please consider surrendering your tenancy as soon as you can. Apart from you not using the house, it's preventing a family in real need from having somewhere to live, and for your own sake, if you plan to get a place in the UK, because inevitably the authorities compare notes, you will have difficulties there if you don't tie up this loose end in Ireland.
