Small Claims and Costs

    Do small claims pay out above the amount disputed? The amount I dispute is €14, the cost of small claims is €25.

    It hardly makes sense to take a claim in some cases if not.

    My situation is as follows:

    I have an Eflow account for the car, and they have billed me for two journeys on the M4 for a truck. Now what gets in my goat is the total "We couldn't give two hoots" attitude from Eflow. I have rang 5 times and I won't be calling again. You see the other half drives the car, was in work on the day in question, was 4 months pregnant at the time, was supposed to be driving a truck, and the best bit is she would need to be doing an average speed of 634km/h to go through the two booths on the M4 in the time frame their itemised invoice states. Now I know its only 14 Euro, however Eflow keep saying they are waiting on the M4 to respond, my intial call was 11 April. The invoice is enough for me to show they are incorrect.

    So my question is can I claim for my time that Eflow have wasted, say by asking for a claim of €100.

    This big company doesn't care about the average Joe.

    Can anyone shed some light on the small claims, I can't find anything in relation to my question online.

    if you want damages..its a solicitor and real court so not small claims. Just call them and let them sort it...not worth the hassle

    No. You can't claim for your time. You're disputing €14, so your claim is for €14.

    OP, I accept that you have rung five times and the matter has not been resolved.

    However, telephone calls are not always the best way of getting things done.

    You could try setting it all out in writing and sending them a letter. If your letter clearly sets out your position, they might just see sense and refund you the money.
