    Hi

    I'm posting on behalf of my sister.

    After 13 years of trading she is now in the process of liquidating her company due to financial pressure.

    She was in PRSI bracket S (99% certain) and hasn't paid herself a salary in months.

    Her husband earns circa €47k and nets €2700 a month. Their mortgage is €1600. So they've about €260 a week to live on - which is very very tough given that they have to cover all expenses and have 3 small children.

    She went to citizens information who confirmed that she is entitled to nothing from the state and she can make an appeal to the CWO if she wants but its incredible unlikely she'll be successful.

    Aside from the fact that she employed 8 staff for 13 years and has paid all taxes the gross unfairness of it towards the employer is evident once again in our mad country. She's just off the phone to me in floods of tears wondering how they're going to cop.

    Does anyone have any suggestions/ideas on what her next step can be?? She's obviously started the search for new employment but the doors only closed on Saturday so there's still a lot to be done liquidation wise.

    Going on her husbands net monthly income provided by you he should apply for family income supplement. Citizens information are correct your sister will not receive any jobseekers benefit as her spouses income will deem her means in excess. There is no unfairness against an employer. If her employees who have lost their livelihood and if they have to apply for jobseekers allowance and their partner/spouse is earning the same amount as your sisters husband then they will not receive jobseekers allowance either.

    Thanks eastbono. However, the employees would be entitled to jobseekers benefit for 9 months before moved onto JA and then means tested so they do have advantage.

    The great news is that she was offered another job today by someone in her industry who heard about her situation which is fantastic news. It all worked out in the end thankfully!!

    Thats great news for her. Her employees would get jsb because they pay an "a" class contribution and your sister paid an S class contribution which doesnt count towards jsb but does count towards old age pension.
