    Hi there.

    Me and the missus started renting an apartment in dublin.

    Signed a 12mth lease with a letting company on behalf of a landlord.

    We are only a month in and circumstamces have changed.

    Now we have been given a 3 bedroom house rent free for the next year or 2 at least.

    Im trying to find out whats the best way to get out of the lease and if we could get our deposit back.

    We have been living here 1 month now and had to pay €1200 for the deposit and €1200 a month so its a bit of change compared to free.

    The letting company where supposed to fix the decking on the balcony and they where supposed to sign us up with esb or bord gais.

    We have recieved nothing.

    Was told we would be set up with upc

    That hasnt happened either.

    Bit of a shambles really.

    Would appreciate any help.

    Offer to re-assign the lease? Do you know of someone who might need somewhere to live?? And that'll be only with the LL's agreement. If he doesn't agree? Then I'm afraid you'll have to eat the rest of the lease. And almost certainly the deposit's gone in any case. YOU are the ones who want to break the lease...

    Incorrect. The landlord can only retain the deposit to cover their actual losses. So if they get a new tenant to move in the day after you leave (not impossible in the current market), then you are entitled to your entire deposit back (minus any reletting costs).

    Not directly relevant to your original query - but you may need to check the Revenue implications of being offered a place rent-free.

    Depending on the circumstances, it could be considered a gift to you, which you could be liable to pay tax on. I'd suggest seeing a tax-professional about this.

    only a month in shouldn't be a problem to a reasonable person you could offer to pay advertising cost or indeed find a tenant give threshold a ring they will know exactly and are very helpful and prtb are excellent if your deposit is witheld landlords cannot muck about anymore no matter how entitled they feel
