Me vs. courier

    I ordered some trainers off ebay. A week later they hadn't arrived. I contacted the seller who checked the tracking number and it said that they had been left in my porch. Well I looked but they aren't there. I was home all day the day that they were supposedly delivered but I didn't hear anyone drive up or open the porch door and there was certainly no ring of the bell. However the courier is adamant that they delivered it. If it comes down to my word vs the courier, what happens? The seller wants me to fill out a lossage form for the delivery company but if they insist that they left it for me then what happens?

    If you paid with Paypal, and i really hope you did, start a dispute saying that the item has not been received. As you havent signed for it they cant prove it was delivered and paypal will refund you. It is not your word vs the courier. You have no relationship with the courier.

    I did pay with paypal. The seller says they will send another pair when I have filled out a lossage form for the courier and they have their refund or whatever from them. But it sounds like this will take a while - also the lossage form is very long and I don't want to fill out pages and pages of cr@p. What will paypal make of this - will they make me fill out the form to get the replacement? The thing is, I ordered these trainers because my old ones have become damaged and I don't have any other shoes at all. I need trainers ASAP. What I'd ideally like to do now I just go to a shop and just buy some new trainers in person and just get a refund for the ebay ones. So really my questions are:
    1. Do I have to bother with the lossage form?
    2. If they make me wait before sending a new pair then can I just request a refund instead?

    I mean in the description it said I'd have them within three days. We're into the second week now and god knows how much longer it will take.

    Well if you're in Dublin pretty much everywhere has a sale on at the moment! You would get a decent pair of trainers for 50 no problem. You won't get it sorted with either PayPal or the buyer straight away.

    I'm in England. But my point is - I don't want to buy 2 pairs of trainers. If I buy a pair in a shop then I want to know that I'm entitled to a refund from the ebay seller rather than a replacement.

    What harm is two? You're gonna need them.

    I've 4 new pairs in the wardrobe. Bought on specials, from Stores so I could try on. Your Ebayers may not even fit.

    Because I don't have a lot of money to spend £60-odd quid twice in a short space of time. If I have to dip into money I've earmarked for something else then I want to know I can get a refund on the others.

    how would you know if the delivery guy hasn't kept them for himself. There's simply no arguement. If they didn't get you, they're supposed to leave a calling card advising of their failed delivery. On the card it should advise if they'll call again or a depot were you can collect your goods youself (local to you).

    I would simply not even mention this failure to the seller, just tell them your goods are not received end of story and maybe report you credit card stolen and cancel it so they cannot charge you anyway!

    and why should you have to buy another set!!

    the lossage form is nothing to do with you. You do not have a contract with the courier and should not have to wait until the seller receives their refund from the courier. That is the sellers problem to deal with. You shouldnt have to deal with the courier at all. Open a dispute on paypal and then escalate it to a claim as soon as it allows you to.

    If they paid by paypal then they have already paid and cancelling their credit card will not help. also, you are asking them to commit fraud when there are simpler remedies.

    I only have one neighbour and I have asked him. I know if he had it he would have given it to me because he's taken post for me quite a few times and always given it to me. But I doubt they even tried him - I was home all day on the day that they claimed to have delivered it and I didn't hear anything. I have 2 dogs who bark at anything and they never barked.

    I wanted to sort it out nicely with the seller because I was worried if I made a claim they might get annoyed and drag it out. But then I realised it seems they're going to drag it out anyway. They are currently saying that they are waiting for the courier to investigate. The courier btw is My Hermes. I googled them today and there are many people online saying that My Hermes have claimed to deliver their packages but there's been nothing there. However I did read on a webpage that if the courier company say it's been delivered then ebay won't give the buyer a refund. Is this right?

    Here's the email I just sent the seller:

    You are messing me around with talk of this claims form and waiting for investigations. I have taken advice on this and I have been assured that my contract is only with you and not the courier. I don't have to wait until you sort it out with the courier and I don't have to fill in a claim form. I didn't receive my item from you and I'm entitled either to get the item or a refund. Therefore, by tomorrow please either refund me or send me the trainers I ordered. It's dreadfully bad service to expect a customer to wait until you sort out problems with the courier. If you send me a pair of trainers tomorrow then I suggest you do so by recorded delivery as your courier seems unreliable. If you don't wish to send the trainers then please refund me tomorrow. If I don't have either the refund or a tracking number for a pair of trainers sent tomorrow then I will leave negative feedback and open a paypal claim.

They emailed me a form but I don't have a printer and it must be printed if it's to be hand-signed. I asked them repeatedly to send me a form through the post but the ignored the request. finally they said that I could write and handsign a declaration that I haven't received it, and take a photo and email the photo to them. I've done this several times but they keep saying they haven't received any email. Are they allowed to make it this difficult? I would just start a paypal claim, but according to reports I've read online, if it says its been delivered, even though there's no signature, paypal will take the seller's side.

    start a paypal claim and escalate it to a dispute. the seller has not proof that it was delivered to your address. the couriers word is not enough.

    But every webpage I've read about it says if the courier says its delivered ebay will side with the seller.

    Now they've emailed me a claim form with a different email address so I'll try that and see if they get it. But you know on the tracking thing, the delivery bloke claims to have left it in the porch? On the claim form it says that it was left in the shed/outbuilding. I don't know whether shed/outbuilding is standard courier speak to include porches or whether the delivery bloke just can't get his story straight. For the record I don't have any shed or anything of the sort.

    I cannot believe what a w@nker the seller is being. They said they could not refund me unless I sent them a hand-signed document stating that I haven't received the item. They said I could write the document, photograph it and email it to them. I have done this many times but they consistently say they haven't received it. I repeatedly asked them to give me a mobile number so I could text the photo but the gave me a landline number and won't give me any other number. They are being so difficult that I have left them negative feedback and opened a case even though I don't have much hope of winning as Hermes say they delivered it.

    you can add pictures to ebay messaging
    keep all conversations to ebay messaging to cover your self
    paypal dispute is the only way, the always side with the buyer, its the sellers problem to claim from the delivery company

    And leave it at that. U didnt get it, you'll get your money. Don't speak to the courier again, dont speak to seller outside of your paypal case. Escalate it as soon as it lets ya.

    It wont/shouldnt take as long as the timeline ul see when you do it.

    Most sellers try and bullsh1t buyers with the replys you've been getting hoping the time for a claim will run out.

    After opening a case and sending many handwritten documents by various means, they've finally agreed to refund me but they say the refund is processing. What does this mean? It sounds to me like they're just blagging because surely all they need to do is click "refund" on paypal?

    Finally, after all the cr@p they put me through and after opening a case, I got a refund. Then the seller had the cheek to send me an email asking me to remove the negative feedback I left them, saying that they don't want their seller rating affected! I sent them this back:

    No I won't! First I didn't receive the item, then I had to faff around sending stupid photos of handwritten letters which you kept claiming not to have received and had to wait two weeks for this to be sorted out. And you threatened to make me wait until Hermes had investigated it before giving a refund, which you had no right to do. You should have done the decent thing and just refunded me when I said I hadn't received it. If you don't want negative feedback then don't treat your customers so badly. My experience with your company has been entirely negative and the negative feedback will remain.
