Hi first off if this isnt in the right area mods feel free to move it. If someone installs an outdoor stove and the smell is coming into someone elses house constantly is there anything that can be done.

    Close your windows :D

Erm, i could be wrong, but i think there has to be a minimum chimney height for an outdoor stove to prevent exactly this. You might have to ask elsewhere, perhaps the council, or planning office might have answers. It's not exactly a BBQ, so might be something that can be done,

It might be worth checking what he's burning in this stove.

I'm not sure if you actually read the link but it doesn't matter if it has a flue or not, a flue is irrelevant. Even burning paper could be illegal.
Burning household waste at home or in your garden is illegal. Examples of where you cannot burn household or garden waste are:
    • In a barrel or exposed pile in the yard or garden
    • On a bonfire
    • On an open fire, range or other solid fuel appliance
    • In a mini-incinerator, for example, a home or garden incinerator purchased from a DIY centre.
Waste burners and other devices such as, mini or household incinerators, which may be located in buildings or gardens, are illegal even if they are attached to a stack or flue

Hire one of these http://www.crosshire.ie/air-conditioning/air-conditioner.php?item_id=477 and put it in your back yard so it blows smoke back on the neighbour. Anyone asks your drying your clothes.

Is your neighbour approachable? If they are it might be worthwhile popping in for a friendly chat to explain the problem and offer any solutions (like a higher chimney for the stove) before going down the legal road.

I wouldnt start haggling or negotiating with your neighbour op. what they are doing is illegal and detrimental to your health pure and simple. Tell em straight that its going into your house and you feel ill. Mention that you dont think the council/management company allow it .

They probably are legal since they're designed to be solid fuel space heaters not incinerators. However using it to burn waste is illegal.

thats why I was asking what it smelt like as I ended up having to close all the air vents and windows to keep the smell out.
