Unpaid Management Fees?

    Hi All,

    I'm on the board of management in a small apartment block. There are a number of residents that have arrears in Management fee's each totaling approx €7k. I'm just wondering what would be the best approach to recover these outstanding monies

    Management fee's can be recovered as a simple contract debt in court. Once you get a judgement it can be enforced by the sheriff. You will likely incur legal fees (which can also be recovered) so you have to weigh up the costs of legal proceedings vs. the likelihood there is sufficient money there to recover. The threat of legal action might focus some minds and you could negotiate a payment plan to clear the arrears.

    The other option as mentioned is start withdrawing services - e.g. parking permits so the non paying resident will be clamped. What you can and can't do in that regard will depend on the rules under which the Management Company was formed.
