Damage to preschool property

    Looking for any advice thanks.

    A preschool is setup in the local village hall, adjacent to this hall is land owned by the HSE which is also rented out separately to the preschool.

    The local national school held a party there recently where children from the national school entered the locked playground by climbing the wall and caused over €1,000 worth of damage to the garden toys.

    The local hall say they are not responsible, the school and their parents association also are saying they will not accept responsibility.

    Does anyone know what the next port of call is? Obviously we will contact the Gardai now but im afraid they will do little apart from note the details and the preschool is still left with all this damage to the childrens toys.

    If it was national school kids the Gardaí won't be able to do much. The age of criminal responsibility is 12. Best to go up the chain of command at the national school through a solicitor. Maybe hit the media.

    You need to recoup the cost of the damage done and therefore your next port of call is a solicitor who will advise you on the best way to go about doing this.

    Can you prove they did the damage ?

    What do your insurers say?

    Haven't spoke to them yet, was hoping to sort it out amicable with the school, will be contacting Gardai and Insurers Monday.

    So teachers were supervising a party and allowed their charges to climb a wall into private property and damage private property? If one of the kids had fell off the wall or been injured on the preschool garden toys then who would be responsible?

    Make a claim with your own insurers. If they consider that the School is at fault they will seek recovery from same via their insurers. This takes away any need for you to deal with the school or the parents.

    Just check the excess on your policy first. You might find it not worth your while to go down this route.

    What about the parents of the children in question? (As opposed to the Parents Association). Are they prepared to accept responsibility for the actions of their children?

    Who was responsible for organising the party and supervising the children?
