Planning for a roof replacement?

    Hi, I'm buying a holiday home in Ireland and have just had a survey done. The property was re-roofed about 10 years ago, the surveyor has confirmed that the roof was completely removed down to the walls and rebuilt, great in one respect that it is a good job but my solicitor is now saying that the sellers may well have had to apply for planning or have obtained a building control cert for this.

    The seller is saying that the roof was placed like for like, it is a slate roof, no roof windows. Does anyone know if my solicitor correct? Just checking as the seller is complaining that he doesn't want to spend another few hundred euro for a cert that isn't necessary.

    "may well have"...... ah come on...

    s/hes the solicitor.. they should know the legal requirement of what requires and doesnt require permission.

    if the vendor has not supplied a cert of compliance / cert of exemption, then its not a clean product to sell.

    Is it exempt under 41H (maintainance). Especially if like for like.

    Yes, if like for like, it would be exempt. Proving or providing evidence it is like for like is another matter.

    A opinion on compliance with exemption from planning permission should be sought from the vendors.

    The sellers carried out major renovation works at the time the roof was replaced and they have already signed a statutory declaration confirming that there have been no developments within the meaning of the Local Government (planning and developments) act and that no alterations/extensions have been carried out. The building itself was built about 100 years ago. I think my solicitor is being cautious as the the sellers live abroad and I would find it difficult to sue them should any problems arise in the future.
