Paying back training

    Hi guys,
    Just asking this for a friend as she isn't on boards to ask herself.

    About two months ago she was hired on a part time basis in a hotel spa, as a beauty therapist. When she got the job she realised it wasn't really a spa at all. It was just empty rooms in a leisure centre. Instead of being able to go in and do her days work, they're expecting her to travel in for an hour or two, and on really short notice. The only services they offer is massage and waxing and nail paints so because treatments are so limited they're not getting a lot of business to the spa. She spoke to them about even just a basic range of products to enable them to do more treatments which was shot down straight away.

    So, she started looking for another job and got one in a successful established spa and handed in her notice to work today. The hr manager came down looking for her and told her she must pay back 300 for the waxing training she recieved as she can put it on her cv and its a loss to the business. There is no contract signed.

    Does she have to give them 300 and can they withhold any wages due?

    Of course not - unless it's in her contract.

    If she signed no contract regarding training she'll owe them nothing. That said, she can probably expect to have her pay docked and have to pursue the money.

    Tell her to copy any and all emails and email her hr to put down in writing what they are taking and why + get them to highlight and copy said clause in her contract if any .....

    Under the SHAW ACT 2005 (Safety Health and Welfare) any training under taking by an employee in order for them to carry out their duties must not come out of the employees wage,This also includes up skilling retraining etc regardless of industry sector and the employee must not be financially at a loss wage wise during the training period.
    Ask the HR person to put it in writing on company headed paper I bet you they will sh*te them selves unless they are complete dopes,I have had companies try and pull fast ones but when I start talking about S.I & EU directives they sh*te them selves and pay for the training.
    I also forgot that there is a section regarding the unlawful deductions of wages another thing that you could tell her to look in to.
