    Hi ,
I was recently in receipt of illness Benefit and returned to work. I was late sending in my final cert and received an extra weeks payment. Hold my hands up I was late, no fraud intended and money is there to be recovered when needed.
Just wondering what the process is for recovery,

Write to the dept informing them of what happened, ask them for guidance on what to do,keep a copy of the letter and get proof of postage.

Believe it or not they won't take it back in one lump sum, they may decide not to take it back at all, too much hassle to be honest, if they do decide to take it back off you make them an offer of one euro per week, they will have to accept what ever you offer, don't be worrying your head about it!!

Non of this is true. If an overpayment has taken place it doesn't matter whose fault it is it has to be paid back because the money is not owed to SW but to all of us. They don't have to accept an offer of €1 per week and are entitled to insist on 15% of SW payment the next time a claim is made.

No, they don't have to accept what you offer them, however the can not take it from your payment without your permission either.

3.4 When would a debt be recovered by withholding arrears?

When arrears are due to a person, all or part of the arrears due may be withheld to repay a debt owed to the Department. The circumstances of the case should be considered to establish if it is appropriate to release a portion of the arrears to the person.

In all cases, the person must be informed of the Department's intention to withhold the arrears and offered the opportunity to give his/her views on the proposal. However, arrears can be withheld without the agreement of the person.
