Seeing as go safe are a private company, can they set up on the hard shoulder of motorways and dual carrigeways,as according to the rules of the road, you can only stop there in an emergency,so would the ticket be valid ???

they never set up on the carriageway/ hard shoulder...always off the road on the verge or in a gateway (and never on a Motorway anyway)

There was a speed camera van on the M7 on Monday afternoon on the raised Garda area.
The f*cking carnage they caused by people slamming on there brakes down to 60kph to crawl by.

Dunno which is worse the "will only be in areas of road deaths" line handed out or the idiots who don't just stay around the speed limit and continue on.

You sure it wasnt broken down? :P

it would be garda camera van not a go-safe one.

In fairness if people are so far out of it or so misunderstanding the law that they slow that much to go past a safe van then its hardly the guards fault. They shouldnt be driving in the first place.

But i agree, when people see a police car, go safe van or similar on a motorway or indeed any road, they do tend to slow to way below legal speeds. I will quite happily pass the traffic cops at 120 on a 120 motorway...when everyone else is filing in behind keeping pace with them...

Yeah, I passed the Gards on the M17 the other day....for several miles they were spot on 120 and I stayed behind them, then they slowed for no obvious reason so I passed them out. There were dozens of people who stayed behind them, for why?

There is a go safe area on the M7, van was parked there last week.
And it was a go safe van.

can you give a precise location?

Map is here. There is no location on the M7 http://www.garda.ie/gosafe.htm

There is on the N7 Dublin side of Naas though

That's the spot, the camera sign is before it changes from 120 to 100.

Edit. On the map one is on the N7 and one stretches between the n7 and m7, that's the one.

Yeah around there corktina, I was sure it was a go safe one rather then an garda one!

On a separate note, I once got stopped by a guard on the M50 for overtaking him at 100kph (on the button) outside lane free, for once, he was on a slip road everyone else was slowing up I proceeded on.
He was trying to do me for overtaking a cop car, as it should be an offence.
I smiled nodded let him rant and rave and was let go eventually by the.....

He actually pulled you over? I presume it wasn't on the M50 or on any of the slipways on or off.

On the M50 itself I was on the main road, he was exiting at tallaght.

    Edit and came after me

There was a go safe van on the m1 - parked up where the gardai do be. 1st - is that not illegal parking since they're not gardai? 2nd - there's no sign of them in that spot on the garda website....

You do know that the Gardai have camera vans too.

Yes thanks I do know that - I also know that it's illegal for someone who is not a garda to park there - hence the question!

If the guards instructed them to operate there, then it's perfectly legal.

No, it is illegal for an unauthorised vehicle to park there. Quite a difference.

Also garda vans and gosafe vans are very similar. There's also 2 totally unmarked garda camera vans, but I think these are used to survey a spot.

Have seen gosafe vans several times on the M7 (not N7) both sides, usually on garda ramps, furthest out was Dublin side of the J14 services.

    Def. Gosafe not Garda btw.

Edit, have seen them parked on hs and foothpaths in my travels.

The Rules of the Road are a useful guide, they are not the law.

    http://www.irishstatutebook.ie/eli/2004/act/44/section/27/enacted/en/html
    Exemptions for emergency vehicles.

27.—Requirements under the Road Traffic Acts 1961 to 2004 relating to vehicles and requirements, restrictions and prohibitions relating to the driving and use of vehicles, other than those provided under sections 49 and 50 (inserted by sections 10 and 11, respectively, of the Act of 1994), 51A and 52 (inserted by sections 49 and 50, respectively, of the Act of 1968) and 53 of the Principal Act and sections 12, 13, 14 and 15 of the Act of 1994, do not apply to a driver of a fire brigade vehicle, an ambulance or the use by a member of the Garda Síochána of a vehicle in the performance of the duties of that member or a person driving or using a vehicle under the direction of a member of the Garda Síochána, where such use does not endanger the safety of road users.
GoSafe only operate where they are directed to by the Garda.

GoSafe vans are sometimes used for surveys, not compliance. Such surveys can be anywhere.

Me too - the footpath in Coolock used to be a favourite before the ramps went in! Also definitely go safe! I thought the sign on the ramps read "garda vehicles only" as opposed to "authorised vehicles" which are 2 very different statements according to law aren't they

But who would prosecute them? The same Garda that told them to park there?

Going to throw a cat amongst the pigeons here.. There is no such thing as a GARDA parking spot. Those signs have no legal status.

Now.. stopping / parking on a motorway is a different matter.

Indeed. The Gardai aren't immune from the same laws of physics as ordinary drivers. If they get hit by a drifting truck they'll be as dead as the rest of us.

    Actually, non-standard signage is permitted.

What? One of 'them' who has seen at least 4 people this past week with a phone in their hand while driving?

I'd like to see 'inattentive driving vans' as that is the number one cause of accident's, not speeding, which is 4th or 5th down the list of primary causes.

Perhaps I am one of 'those' - a German.

permitted.. but a summons cannot be issued. so.. no legal consequence.

Not prosecute - however invalidate all speeding fines?

if you have a good solicitor, almost every GoSafe ticket can be successfully contested.
It just hasn't happened yet.. Mikeecho had a few posts that showed the loophole, you just had to read between the lines of the tech specs he posted. He was aware of the caveat .. dunno if many people picked up on it.

Seen one on the M50 but it may just be doing it under request. Before the off ramp for Firhouse. Really looked like a Go safe as opposed to Garda due to design. Could always be wrong.

If you only noticed 4 people while driving over a week, then you may need to take time to become more observant while driving. I see more than that while taking a 5 minute spin into town

Not much different when I visit the countryside, in fact, it might actually be worse. When I visit the homestead, it is pretty clear I would see at least that number in 30 minutes, on a quiet day. It's not everyone but at a minimum, 1 in 5 (anecdotal evidence, not real evidence).

Evidence collected 'illegally' would be my guess at where he's going, that said, I'm not sure how you'd fare with line (here anyway).

There are no issues of "illegally" obtaining evidence in relation to the location where a GoSafe van is parked.

Previously it could be argued they were exempt from any traffic and parking regulations as per S87 of the Road Traffic Act 2010 (which replaced but kept the same exemption which Victor quoted previously).

But GoSafe vans were specifically exempted from the Traffic and Parking Regulations 1997 in August 2016 for the avoidance of doubt, legally any traffic and parking restrictions don't apply to them in the performance of their duties.

Does that include parking across 2 disabled spots outside at the local Centra????

    (purely hypothetical ;))

Yes they are now exempt from traffic and parking laws when performing speed checks so the prohibition on parking in such a spot does not apply.

Starting to think blue badge spaces are only for ****s and giggles outside my local Centra, every evening someone (without a badge is parked on them, and often across two of them)

There was a camera van, unsure if it was GoSafe or a Garda van, parked in one of those raised bays the Gardai use on the M1 inbound between the services and the Donabate exit last week. First time I've seen a van on the motorway.
