does someone else's redundancy affect me?

    Hi,

    I have to be vague but hoping someone can help me.

    I work on a small team and we each do the exact same job.

    Hours of work are similar enough, someone starts early, I come in normal time and another person starts a little later.

    We change this around when covering each others annual leave etc.

    some people are being let go.... and no-one wants their shift.

    Am I right in saying if that person is made redundant their shift goes with them ?

    I would say the job is being made redundant not the shift so if there are two or more on one shift you will be expected to cover the shift that the person who is being made redundant is doing.

    I thought that just thought it might be worth checking.

    Do you know if you can refuse to change hours permanently ?

    Its only my opinion but i think if its not in your contract or you dont have one the hours you have been working are your set hours.

    But if you refuse and it goes to a tribuneral they can say it was in the best interests of the company and you refused which probably wouldnt be looked on very well.

    As i said its only my opinion maybe look on the Nera website or give them a ring.

    No. As Martin says, it's the job which is being made redundant. In effect this means the company is saying that they don't have work for e.g. 4 people, they only have work for 3.

    In addition, I'd look at your contract. Even if it specifies your Start & Finish times, I suspect there will be a clause that says e.g. "The company reserves the right to vary your hours in accordance with business needs" etc

    If that clause is there, you have no grounds IMO.

    It depends on why the person is being let go?

    If there isn't enough work than how is the shift still available?

    This isn't as black or white as some posters are suggesting, further although there may be some terms in your contract of employment, you would need to look at this and how management is making the decison on who will cover a job that no longer exists ?
