Iphone RUINING MY LIFE!!

So my iphone 4s has been giving me loads of problems the last 6 months, I have it 18months. won;t connect to wifi at all, freezing, being generally crap. have to keep rebooting it just to send a message. I have tried all usual avenues to get sorted, but best meteor will do is give me an early upgrade in september. So I am really reluctant to get another Iphone since this one has been so bad. was fine for about a year, and then just problem after problem. apple and meteor both really unhelpful, saying stuff like, "well the phone is 2 generations behind" yes, but i am locked into 2 year contract and can't afford to upgrade/get a new phone every 6 months. with this in mind, am i better off getting a different phone, and any advice on which one? if i'm locked into a contract for 2 years with a phone, i want it to work reasonably well for the 2 years, is this not fair?!

It's 18 months old at this stage, you opted to get into the 2 year contract so there's no need to be asking is it fair?

Regardless of the 2 generations behind you should still be covered under warrenty by apple ;)

On the part i highlighted above, is your wifi button greyed out? If so then apple will replace the phone for you.

If its over a year old, the problem is with Meteor, not Apple. Small claims route for an 18 month old phone. Problem is, you can only claim the value paid, i.e. €99 upgrade, €99 is all you can claim.

Here is some info that might help but from my experience you are going to have to deal / argue with their head office / Facebook

The manufacturers warranty period is 12 months and any faults inside this period can be repaired under the warranty free of charge. However after this your EU consumer laws - statutory-warranty - come into play (think back to business studies in secondary school) ... the grey area is you need to prove the fault was in the product from the start (when you received it) and then meteor (who the contract is with as you bought from them) has to help you “free repair or replacement where a product does not correspond to the contract...”

I would argue if you didn't drop it / damage in water etc then there must have been some type of fault that is getting worse with time. I am in no way an expert on any of this but I did get my my iphone replaces before using the statutory warranty so best of luck – here more info and link from apple site :- http://www.apple.com/ie/legal/statutory-warranty/

In most EU member states, consumers may only claim for defects that were present on delivery. The burden to prove that the defect (including latent defects) existed on delivery generally shifts to the consumer after the expiry of a period of 6 months from date of delivery. During the claim period (see above), consumers may claim, among other things, free repair or replacement where a product does not correspond to the contract. Some EU member states, including Finland, Ireland, UK, Netherlands and Sweden, have a claim period that is longer than 2 years from date of delivery

wi-fi is greyed out, looked on other threads on here but none of them gave this info about warranty being 2 years

just to clarify - apple cover the first year but then the statutory warranty is up to you and the shop you bought it from (so in this case I am guessing Meteor) - if you bought it in Meteor you need to go through meteor who in turn will send it to apple ...

thanks, have been into meteor shop already, but no joy. so i just messaged them there, will see what they say! have been going around in circles

The Wifi Greyed out is an issue apple themselves are covering as its a design fault with the Wifi chip. It overheats and the solder loosens.

Have you any proof of that? Nothing on the apple support site about it.

That second link is wrong. Apple provide one year warranty. There is another year where you can bring it back to the seller to repair, replace or refund.

Not in Ireland. We use the Sale of Goods Act with the seller, as it affords the consumer better protection than the EU directive. It actually makes reference to it on the Apple website.

1000% incorrect. Apple are not covering it.

apple say its not their problem, meteor say it's not theirs my head is wrecked. apart from anything else, phone won;t even make calls or send texts half the time. it's just not fit for purpose

Might be worth taking it to an iPhone repair shop and seeing if they can do anything. They'll be able to fix the wifi and might be able to help out with the rest.

i had a similar issue withmy 4s before i upgraded.try and reinstall the os it is on or 7.1.1 now if that does not work i found GSM solutions brilliant at fixing the issue with my one. it was a faulty rear camera connection in the end

  • Registered Users, Registered Users 2 Posts: 93 ✭✭Henry94

We had the same issue with a phone at work. I'm too new to post links but the upshot is take it into a repair shop and ask them to replace the wifi chip.

  • Registered Users, Registered Users 2 Posts: 131 ✭✭millivanilli

i've already taken into 2 repair shops who say they can't do anything, both said it was an apple software problem. it is on latest ios

You bought the phone from Meteor, its their problem. How much did you actually pay for the phone?

I got the phone free for signing up to 2 year contract. meteor refusing to do anything. going to try consumer agency and get advice from them. my contract with meteor is up in sept am never dealing with them or apple again!

  • Registered Users, Registered Users 2 Posts: 104 ✭✭dubjay

if it was a software problem all iphones would be the same its definatly a hardware issue making the software react badly.i would give GSM solutions a call and see what they say.all software problems are fixed by reinstalling a os

The problem is that if you go to the Small Claims Court, which costs €25(?), they can only award you what you paid, not the actual cost of the phone.
Personally, I would put it in writing to Meteor, why exactly has gone wrong with the phone, including the details of the conversations with Apple and Meteor. Give Meteor 10 days to rectify the situation with a new phone or you will initiate SCC proceedings, with a view to you receiving a replacement iPhone. A lot of companies won't fight it, even if they do, for the sake of €25 it might be worth it.

Ok my advice is to ring Apple Directly

    http://support.apple.com/kb/ts1559?locale=en_GB&viewlocale=en_GB

Ring them and say that you are covered under your consumer warranty however meteor want to send it back to an unauthorised Apple repair agent for fixing.

Having had experience with Apple, they can take over then, Apple sometimes will go beyond what is expected of them, and other times perhaps not.
However It is worth a try.

My own issue I had with the phone after 14 months, I said this story with three wanting to send to fonemenders, and they agreed saying it was not an ideal solution for me so they offered to do this through themselves and take over.

http://www.citizensinformation.ie/en/consumer_affairs/consumer_protection/consumer_rights/consumers_and_the_law_in_ireland.htmlConsumer contracts are protected by the Sale of Goods and Supply of Services Act, 1980.

Under this Act the purchaser of goods has a number of rights - the main ones are:

Goods must be of merchantable quality – goods should be of reasonable quality taking into account what they are meant to do, their durability and their price
Goods must be fit for their purpose – they must do what they are reasonably expected to do

Quote this at Apple / Meteor, you're protected, you just may need to stand your ground on it. Solicitors letter would be the right way forward rather than SCC IMO

My iPhone 4 is approaching said many of years, ie Four years with more falls and abuse that you can shake a fist at, it never got wet though, even a tiny bit damp, I was anal about that.

Just mentioning as a comparison. I also know my iPhone 3 is still going strong too, that's six years in service ~ and I hammered that phone.
