Query regarding driving disqualification

    Hi all,looking for help on the above titled,my brother in law who never had and still doesn't have a licence,back in 2006 he was disqualified from driving for 2 years,however as he never had a licence and now wishes to apply for one what is the legal position surrounding this????

    Technically you are not disqualified from driving, you are disqualified from holding a driving licence. Your brother-in-law needs to apply as a raw beginner which means theory test followed by driving test.

    There should be no issue at this stage. There may be a lingering endorsement still knocking around that would come into effect if he were to get a licence.

    Thanks for that!does the fact he nevervheld a licence mean the ban has yet to start???not 100% sure but i think i may have seen/heard about that a long time ago!e.g once disqualified a licence must be surrendered,yet he had none in the first place and as it stands still doesn't,he's only looking at getting it now,but yes you are right on the endorsement,he had one imposed,which hasn't commenced.
