Loss of Deposit on Holiday

    Not too sure where this should be posted i.e. legal or financial but here goes. Me and my wife booked an apartment and paid a deposit of 500euro. When the time came to pay the rest we contacted the owner but got not no reply back. After sending numerous e-mails we eventually got a reply saying apartment no longer available will refund deposit. Since then we've made phone calls, left messages and sent e-mails but have had no reply back. Our flights are booked and we have secured another apartment but need the deposit repaid. Has anyone else had any similar issues or could advise us. We booked it through a go-between for people renting they're apartments called owners direct but the site have no legal obligations to cover any losses. Also they informed us that the apartment has been taken off there site as fees have not been paid.

    How did you pay? bank transfer? Paypal? cash? cheque?

    True but it's not impossible to enforce; depends on the country really, no?

    There is a European small claims procedure that could be used, if the other party is in Europe.

    If you paid by credit card you should ask your bank for a charge-back, if by paypal commence a payment dispute, otherwise you're in trouble.

    That was exactly my thought process in asking how you paid. You might want to look into the section Q102 on Mondays after 6pm with Dermot Joole (may have spelt his name wrong) from the CAI (Consumers Association of Ireland). They deal with this type of issue and advise on what your options may be.
