Ok so the roots of my bay tree have come out through the end of their pot and basically started to lift the pot sideways. Can I cut the roots off flush with the base of the pot without killing the Bay Tree? Tree is about 6' tall and in the pot for about 12 years, if that makes any difference !

That's how bonsai trees are trained. It might be a better option to repot it into a bigger pot, but yes, you could trim the roots. Congratulations on keeping a bay tree in a pot alive for 12 years! :-)
