paid for a service that wasnt provided in full

    I have been paying for a service off a provider for the last six months, and I havent been getting the required service. They have pretty much said that its due to a fault of theirs, any advice on if I could get back all the money I have paid?it looks like I will have to take the legal route if I do get anything back they are pretty much told me I can cancel it and get back €9 even though I have paid over 350 for it so far

    You are looking for a full refund on the basis that there has been a failure of consideration under the contract.

    Be aware that if you have received some useful benefit or service under the contract you may not recover the full sum if there has been partial consideration / partial performance rendered by the other side.

    That said, an offer of €9 is quite insulting as against what you are paying and the fact that they are accepting your essential complaint (as well as your money). Sounds typically modern.

    Sue them.

    If it is something like broadband they usually have a clause about the stated amount being the maximum speed achievable and not the average speed.
