Planing permission

    Hi a quick question about planing permission it says online no planing permission is needed if the extension is to the back of the house what about if it is in your back garden but on the side of the house is planning needed then? Also if you are to get an extension with a room in the roof of it the attic area of it is that counted towards the sq foot of the building as anything over 40 sq metres it says planing is needed.

    Planning is needed to the side. Attic does not effect 40msq but does arguably affect the area requiring assigned certifier under the new building control regs.

    The area of attic conversion does count towards the 40m2 total.

    In regards to building control and commencement notice lodgement, the attic area will be taken into account as new construction for the purposes of SI9 in Dublin City.

    It will be counted too by those appointed to offer an Opinion on Compliance with Planning Permission which the Law Society requires it's members to seek during the sale or re mortgage of a house.
