builder ran awasy with money

    Contracted someone (sole trader) and gave him 1,440 for materials. After many excuses: dentist appointment, rain, not feeling well, son going to hospital . . ,. I told him we no longer needed his services. I haven't been able to recover the money. Its excuse after excuse, the things he comes up with its simply unreal. He keeps in touch and vrerplky to all texts but there is no sign of the money being returned. I sent him a letter through registered post but vaccording to the website he wasn't at home or refused it.

    The letter says I am giving him 7 days before starting legal action through the small claims cvourt . he is not Irish and I'm worried he is only buying time before leaving bthge country.

    If it goes to court and is forced to pay me back but doesn't, I'm just wondering what would the next step be ?

    Can people really get away with this in Ireland ? ?

    After judgment, the next step is enforcement of judgment; attempted collection by Sheriff/registrar, followed by instalment order and committal/order on failure to comply with instalment order.

    Google Order 51A of the District Court Rules.

    Where are the materials?

    Might it be worth your while making a fraud complaint to the Garda? However, they may view it as a civil matter.

    Thanks Victor. I went to the Garda to report him for fraud. Can't remember if I mentioned the money handed to him was for materials. Anyway they said it's not fraud because "I gave him the money, he didn'T steal it" . . .

    Another lazy/ignorant guard. If he stole the money, it would be theft. There are plenty of fraudsters who are "given" money. It can still be fraud though.
