Returning transfer of entitlements

    Hi All,

    My brother transferred entitlements to me for 7 years, there is still 5 years remaining. I wish to return these entitlements to him as I am no longer going to farm the land associated with them. How do I go about doing this?

    If he owns the entitlements and they are leased to you and neither of you have submitted a claim this year i.e. before the 15th of May you have probably lost them. Whoever claimed them last year has relieved notice of such from the department of agriculture.

    No they have been claimed for this year, I want to sort out giving them back to him for next year.

    A transfer of entitlements form signed by both parties might be all you need to show you are no longer leasing them, you might not even need this since the current entitlements scheme is coming to an end this year. But there are new criteria to say whether or not your brother will be entitled to draw down the entitlements in the new scheme, these would need to be studied closely. Particularly had he all his entitlements leased out in 2013?

    The department published a guide called CAP 2015 An Introduction to Direct Payments. You might find some useful info there.
