Green / Red diesel

Everyone (or nearly everyone) knows that being caught with green diesel means trouble if customs nab you.

In NI, they have RED diesel, it has a different dye.

If I, as a resident and citizen of ROI were caught with my southern registered car in ROI with red diesel, could customs seize it?

I know that they are losing tax of fuel, hence the fine, but it'd really be no different if I were to purchase diesel from a legitimate petrol station up the North.

What if I was driving a Northern Registered car and I was caught with Red / Green Diesel in the south?

    Could customs do anything?

I work in NI but live in ROI. I'm genuinely just curious.

I live on the border and know of a few people from the north caught with green and ni customs let them off. But I'm afraid its a loophole that may now be closed. This was going back a few years....

Don't know how customs in south deal with red in their jurisdiction.

I'd say the offense is using "marked" gas oil, and the cour of the marker doesn't matter to the revenue commissioners
