Caught using mobile phone

    Hi all

    Was caught using phone in recent crackdown - not texting - phoning. The guard who stopped me said its an automatic court summons however I read in the Irish Times that the summons were only for the more serious offence of texting.

    A friend of mine also caught on the same day was told by guards it would be fixed fine plus penalty points

    Anybody got some light to shed?

    Thanks for that - it looks to me like texting is separate so i may just get the fine and points - I'll just have to wait and see

    You need to get a solicitor because from what I've seen here you're not going to do a very good job of explaining what happened to the judge.

    It looks like the garda got it wrong and it should have been a ticket issued there and then with points automatically applied. However, when these offences go to court, the points usually go up and there is nothing the judge can do to prevent that upon conviction.

    Seriously, only a solicitor will be able to sort this out for you without you getting a higher fine and more points in all probability.

    I'm not in court here so I didn't see the need for a three page spiel. Solicitor will cost more than the offense is worth so there's not much point there.
