legal seperation maintenance

    Hi please advise I think I am loosing my mind over this. Basically separated 3 years always payed maintenance voluntarily to kids all clothing school costs etc that's my job their my kids but now served with separation papers and my problem is this

    My wages 1156 fortnightly, have rent loans from marriage etc nothing left after everything yet my ex now wants maintence for herself as she is claiming disability, wants me to pay child maintenance as well and also pay all our debts circa 42k from marriage.

    I pay 180 monthly for the two kids, I buy all there clothes, pay all school social fees glasses etc bring them on hols and try so hard to be a good dad.

    Can a court give her more when I have nothing left for me as is, getting tired of sitting in cold because I cannot afford to turn on the heat

    Judges make mistakes and sometimes make overly harsh orders. Therefore, you need lawyers to represent you and advise you on the possibility of appeal, if matters should come to that.

    You need to hire a solicitor.

    I have a solicitor !! my problem is my ex has free legal aid and all the benefits from the state. I have one wage taxed as a single man and it seems I will now need a barrister to draft up response to her demands

    How is this fair !! actually fair or not this is my reality

    I am not an accountant but maybe you could look into whether you should be taxed as a single man.

    According to Revenue as I live in separate accommodation to my ex and only one spouse can receive tax credits etc for the children then I am taxed as a single man

    My ex has no inclination to sit down and discuss this situation rationally

    Well to be honest they if you are on a wage of over 1100 two weeks a judge will probably make you pay more maintenance as you make more than I do and i pay 300 Euro a month for one child.

    Correct me if im wrong but if you post implies you have to pay your wife money for her disability im not sure if that can happen and if they debt of 42K was created while both of you were married then she has a responsibility to pay her share of the debt.

    as everyone has advised contact a solicitor who will give you better advice than us here,also make sure you keep a record of all the things you pay for in relation to your children,this will build a case for what you actually do and will only benefit you in this issue you're having

    The debt was accumulated mostly due to a business she started which failed and the sale of home not covering mortgage because she delayed signing papers for year after offer was received.
    I may have 1100 but after I pay all of accumulated debt car loan rent etc I have nothing left ans now will have additional costs of solicitors grrr

    Do a search for citizens information articles on spousal and child maintenance and that will tell you the limits and give you other information.

    You might also get some more information/advice in the Seperation and Divorce forum, you could pm a mod here or ask for the thread to be moved
