Off-road / motor tax anomaly

    Here's one for you.

I bought a car on 15th March, with the intention of declaring it off-road while restoration work was being done.

I did not receive the RF101 form until 2 weeks later. I then discovered that one only has 10 days after purchasing a car to declare it off-road.

I cannot now do so, because you cannot do this if the vehicle is not currently taxed.

I can't tax it, because I have no insurance on it, since it's not been in use at all.

    So: I can't tax it; I can't declare it off-road.

    What can I do?

The Motor Tax office tell me this is an anomaly (i.e. the rules weren't thought out properly), and that I'd have to tax the vehicle when I put it on the road then pay all the arrears back to when I bought it. But that might be a year - so I'd then have to pay 12 months' arrears when I'd never had the car on the road.

That's surely unfair and not what is supposed to happen.

    Any ideas anyone?

    Ta

You could tax it for 3 months....then declare it off the road
Obviously the insurance company and policy number you put on the form would be false, but if the car is not going anywhere near the road then it shouldn't cause any problems for you.

Before the high-horse brigade jump in I am not advocating driving the car while 'taxed under false pretences', simply pointing out an option that you could consider.

If you're not worried about the number of owners on the VLC then simply change ownership and the 'new' owner should get the VLC back within 10 days and declare it off the road.
Personally changed details on 2 cars last week and received the VLC's back within 3 days each time.

    Sell it to your brother/father/friend/dog.

That's a bigger anomaly and evidence that indeed it wasn't fully thought out. Perfectly legal, if not Cricket.

Wait till the repairs are nearly done. No point in adding owners now if the car won't be driving and it takes longer for the change of ownership to arrive than time you can declare it off the road.
