Speeding ticket - To fight or not?

    Hey there...

    I got a fixed penalty notice in the post today.

    108 kph in a 100kph zone...seems harsh to me. What about the "10% rule"? I thought that a 10% tolerance was generally factored in to account for speedometer callibration issues.

    Should I try and contest it?

    It was northbound on the Arklow bypass.

    On what grounds are you going to contest? If you were clocked at 108 by a laser beam then your speedo was probably reading higher than that.

    P!ssing into wind contesting. Take the it on the chin and pay the fine.

    there is no 10% allowance. In any case your speedo was probably reading anything up to about 118 or so anyway.

    If you where caught at 108kph, your speedo was probably reading about 115ish? So you knew you where speeding. Nothing harsh about it really. I'd pay the fine and move on. :)

    I agree it is harsh, but 100 is 100, I don't think that 10% you refer too is the law, I could be wrong, but unless you could prove that your speedo reads 100 at 108 then I don't think you have a leg to stand on, and if you contest and lose does it increase? if it does I would just pay it ( it would really piss me off but I would just pay it) :mad::mad:

    Is it reasonable ? No. Is it legal, yes, unfortunately it is.

    I got done for going 67 in a 60 zone. I paid up and **** up.

    It will be exponentially more if it goes to court. You are pissing in the wind.

    I, like you, agree with a graduated fine system, but, alas, this is Ireland so something so logical will never happen.

    You can't deny a summons though and it's coming from the same initial detection of the offence. The best you might manage in court with that one is the 2 points and €80 fine, rather than the 5 points and larger fine a court conviction carries.

    The 10 % thing is usually the Garda's discretion if you're caught by a tripod mounted gun manned by a Garda: they can make a decision on the spot whether or not you're a danger on the roads and exercise discretion. Van detections (both Garda and GoSafe) are automatically processed so there's no scope for discretion.

    I just think that 8% over the speed limit on an empty road is harsh.

    Even the earlier poster doing 67 in a 60 zone was 11/12% over.

    I'll just pay the €80 or whatever it is and move on.

    You'd have been fined about 30 Euro (50 max) and no points were it Holland. Points are only applied when you are 50 above limit.

    8k's over is harsh. No doubt about it bud. But this is Ireland.

    What a full 8k or 5 miles in old money over the speed limit....

    why weren't you doing 80kph on your speedo actual speed 75kph in overtaking lane.

    Cardinal Sin speeding especially on that straight stretch of dual carriageway.

    Unfortunately you have no defence as there is no offical tolerance.

    I too have heard unofficial tolerance limits
    was 10 then 5 and latest was 3% from a primetime story on flash for cash vans. But it wasn't offical 3% it was just pointing out if not correctly set up their could be an error of up to 3% eitherway

    Looks like your best opinion is just pay the fine and accept points.

    I'm sure I read somewhere that speedometers are allowed to read +10% but not below when designed/manufactered.

    But regardless, if your speedo is inaccurate it's upto you to know, probably some correlation to the ratio of cars you overtake to the number that overtake you would give a hint....maybe :p
