New Mobile Phone laws

    Quick question: Can you be caught for using a mobile (one hand on phone near your lap) by a garda car on an overhead bridge on the motorway? Is there any way they can take an image or whatever? If Phone was not at the ear just below the steering wheel and it was raining

    It's just a general question really .... Not guilty myself

    If you get a summons for it though, it would be well dodgy trying to argue it

    If they wanted to make an example of you for the shiny new law
    they could pull your phone bill / records and a bit of traffic camera cctv

    then you'd be up for perjury or something - 7 years transportation/ hard labour for that

    There at about 3 minutes into that

    - the scooter/camera setups have collected €160,000,000 on 12 months in one city

    they could just be doing dry runs at the moment .....

    You (or your friend) could buy a phone cradle.....for future use so that there would be no chance of being caught.

    Phone doesn't need to be in use. As far as I know, it doesn't even need to be powered on. The offense is to hold or cradle a mobile phone with any part of your body, which you were doing.

    A guard will not be asked to produce a picture of this happening in court. If he states that he saw you with a phone, that will satisfy the court and unless you have a rear-facing dashcam or some way of proving him wrong, the court will accept that.
