Building Control and Extending planning

    If one were to be building under the old building control regs but didn't finish the build before the planning expired, then would a new commencement notice be required if an extension to planning was granted from the coco?

    Potentially yes, any extension of previous permission would be required/submitted prior to expired permission.
    Edit: my colleagues tell me retention applications cannot be submitted retrospectively

    I'm sorry but I'm not clear if a new commencement notice would be required from this.

    But thanks for letting me know that I have to apply for the permission to extend before it runs out.

    I would expect that if the works continued unbroken from the first start date then from a building control perspective that you just carry on to completion - while at the same time separately sorting out planning.
