    Hi

    Brief overview
    Separation, 2 kids aged 11 and 15.
Mother has moved out of the family home, father remains in the home and kids want to stay with him.
No violence or anything like that.

Does anyone know if the kids can stay with their father in the family home?
The solicitor never mentioned anything about the kids age.

They can of course stay with the father. But if the mother was to challenge for custody 99% of the time a judge will give the kids to the mother. The 15 year old might be allowed speak up and say where s/he wants to live but the 11 year old will have pretty much no option.

Call me materialistic but the question of residence in the family home is equally going to be a battleground. Particularly in the case that is owned wholly or partly by the couple . To clarify - whoever gets the kids also gets the house ...generally of course .
