Questions re settlement agreement of employment dispute

    Can the settlement agreement of an employment dispute protect a person {in a managerial position} when it's subsequently discovered that he committed serious {maybe criminal ?} offences which caused the dispute in the first place?

    The offences in question were: falsifying & hiding my job description, conspiracy to defraud {I have proof I was set up by this person & two others}, multiple deceptions relating to the standard of my work {all of which I can prove} & a false allegation of theft based on deception. I lost my job {constructive dismissal} because of these deceptions, but I only found out about them bit by bit six months to two years after the settlement agreement was signed.

    I've since had two meetings with the employer & explained everything to them, but they steadfastly refuse to do anything about it, saying the settlement agreement was final.

    Are they correct? Can they protect the individual in question in this way? Or are they vicariously liable for his actions?

    If I say you have no case you should not take my word and see a solicitor.

    If I say you do you will have to see a solicitor to do anything about it.

    See where this is going.....

    Thanks guys ~ I have every intention of going to see a solicitor ~ I'm just trying to get some opinions first ~ I don't want to waste his time & my money

    Most settlements are based on full disclosure of the truth. What you're saying would appear to contradict that. As above, see a solicitor.

    so you quit a job due to stress 2 years ago and now you want to sue them? Have you worked since? Deception sounds a very strong word, was this job crucial to national security or something....and you suddenly have proof...i would be forgetting about this and moving on with life...its too short..

    Thanks for your reply, but you really should address what I actually wrote ~ not what you think I wrote or meant

    I never said anything about stress or suing my employers ~ the two meetings I had with them were very cordial

    Deception happens all the time in all walks of life, so your comment about national security is very ill informed

    I didn't suddenly find proof ~ it took me two very long years to work out bit by bit everything this guy did

    Would you let someone away with screwing up your life & destroying your good name & reputation if you had proof {backed up by documentary evidence} of what he did?

    My query was about whether this guy is protected by the settlement agreement ~ perhaps you might like to address that instead?

    I lost my job {constructive dismissal}
    &
    the settlement agreement was final.

    From This I assume you took a case against them and reached an agreement?

    If so who aided you at the time?
    if you had proof {backed up by documentary evidence} of what he did?

    You need proper advice especially in light of the settlement which was reached previously.
