Returning to same job, less pay

    Hi, I am returning to the exact same job in the same workplace after a period of 7 months. I was previously earning 12 euro an hour, which has now been reduced to the minimum wage. I had basically been working on call for a year and a half, however I was getting full-time work; no week passed in that year and a half where I had less than 35 hours work. I had notified them in August that I was returning to college, but would still be available for work. However a resignation letter was demanded. I did not give a resignation letter as I was not resigning. All contact had ceased until 2 weeks ago when they asked me to return for the summer. Should I still be on my previous wage as opposed to the minimum wage.? Thanks!

    7 months is a long time in this instance.

    IMO this a new contract of employment. You say you were not resigning, but you weren't available for work - how can this be? It seems clear to me that you DID leave and you should have resigned properly.

    If they offer you work, you don't have to take it. Or, you could take the lower pay and try to prove yourself in the role again, and then ask for an increase.

    In answer to your final question: No - in my opinion. You broke the contract of employment, and this is a new start.

    You left your job, went to college, and have now returned. I don't see why they would employ you under your old contract since you stopped working under your old contract?
