Breach of the Peace query

    A friend of mine 14 years ago was caught urinating in a alcove off the road , a Ban Garda was the officer who took his details,

    Which he gave and acted accordingly

    The case went to court in Brunswick Street, this person had no representation and on the day the judge had called out a lot of cases were there was no shows so straight after all the no shows was his case , the judge gave him Breach of the Peace, and fined him 100 pounds. the same judge gave another person who did exactle the same and hit a garda the same punishment.which seemed a bit unusual for the lesser incident

    He was going back to the USA the following year so he had to appeal this because of the breach of the peace Decision , so it went to the District Court and was successfully appealed ,
    What he would like to know as this was appealed , is this still a conviction ,ie is it on record , if someome could explain thanks in advance

    We can't say. It would be useful to check with the courts office in the location of the case. Presumably the appeal went to the Circuit Court.

    new law coming in for drivers section 31 of the act requires that holders of driver licence must notify the licensing authority if they have been convicted of an offence
