    Is a builder obliged to issue an invoice on foot of an interim certificate or is presentation of the certificate enough to demand payment ?

    In order to be able to sue for payment an invoice needs to be issued.Normally it is agreed beforehand that payment must be made on completion of the interim certificate before work progresses further.

    Yes. The exact timing of the invoice may be a sensitive matter for the builder as it may cause a VAT liability for them immediately.
