Rent Relief - Wife Question

    Hi,

    Can someone help me with an issue that my wife is having with the revenue.

    We got married late last year and as a result, we both joined to have equal tax status.

    As a result, revenue rang her regarding her rent relief which she was getting for the last 4 years at the property we both lived in.

    She advised them that she pays no rent to me as principal owner of the house fearing that I might get fined or something

    Her tax credits have been reviewed and she will lose 1,000 euros of credits for 2015 tax year.

    Can she not say that she was paying 500 € a month, which i am allowed under rent a room scheme ?

    any help or opinions will be a big help

    The rent a room scheme does not apply to connected persons such as your wife or partner.

    If she was claiming rent relief then she should not have been and now you have to pay back the relief you were not entitled to claim.

    I am afraid that there is nothing you can do only pay the tax

    You sure about this? I know that Section 216A TCA was changed so that relief is denied for payments from child to parent, but I thought that was as far as it went?

    I think the case of the partner is not allowed rent relief, so it's a poor weekend for us. Thanks to those who responded.
